This Privacy Policy describes how Arbs LLC, a Delaware limited liability company, with a principal place of business at 8 The Green, Suite B, Dover, Delaware 19901, doing business as Arbs or ArbsXYZ, collects, uses, stores, shares, discloses, and otherwise handles personal information when you visit https://www.arbs.xyz/, access or use the ArbsXYZ website, platform, software, dashboards, applications, APIs, bots, alerts, analytics, communications, marketing activities, social media, community features, and other services that link to this Privacy Policy.
For purposes of this Privacy Policy, “ArbsXYZ,” “Company,” “we,” “us,” and “our” refer to Arbs LLC, and “you” or “your” refers to any person whose personal information we process.

1. Personal Information We Collect
We may collect personal information that you provide directly to us, personal information from third-party sources, and personal information collected automatically when you use the Services. We do not intentionally collect special categories of personal information, such as health information, racial or ethnic origin, political opinions, or biometric information.
Information You Provide to Us
We may collect identity data, such as your name and username; contact data, such as your email address; financial data, such as billing address, transaction history, and payment card details processed and stored by Commas, Inc., with ArbsXYZ not storing full payment card details; communications data, such as emails, support messages, feedback, survey responses, and other correspondence you send to us; community data, such as content you post in the Asymmetric Discord community subscriber section or other community features; and account, subscription, preference, and configuration information you choose to provide.
We may also collect wallet addresses, usernames, handles, API keys or tokens you choose to connect, trading preferences, alert preferences, watchlists, strategy inputs, positions, balances, trades and other information you submit through the Services. We will use other data not specifically listed in this Privacy Policy as described in this Privacy Policy or as otherwise disclosed at the time of collection.
Information From Third-Party Sources
We may receive personal information from third-party sources, including Commas, Inc. for payment processing, Discord, Inc. for community access, analytics providers, publicly available sources, data providers, identity or authentication providers, payment processors, messaging platforms, blockchain analytics providers, wallet providers, prediction market platforms, social media platforms, and other third-party services you use in connection with the Services.
Information Collected Automatically
We, our service providers, and our business partners may automatically collect information about you, your device, and your interactions with the Services, our communications, and other online services through cookies, web beacons, and similar tracking technologies.
Automatically collected information may include technical data, such as IP address, browser type and version, operating system, device identifiers, referring URLs, and time zone information.
Automatically collected information may also include usage data, such as pages or screens viewed, features used, session duration, click data, platform activity, time spent on a page or screen, referring website, navigation paths, interactions with emails or messages, search terms, dates and times of access, and crash or performance data.
Blockchain and Public Market Information
If you connect a wallet or interact with blockchain-based services or third-party prediction market platforms, we may collect or process wallet addresses, transaction hashes, smart contract interactions, market positions, settlement information, publicly available blockchain data, and publicly available market data. Blockchain and prediction market data may be public, permanent, and not controlled by ArbsXYZ.
2. How We Use Personal Information
We may use personal information to provide, manage, operate, maintain, secure, authenticate, personalize, improve, and develop the Services; administer accounts and subscriptions; process payments through Commas; provide customer support; communicate with you; send transactional communications, including receipts and account notices; deliver alerts; operate dashboards; enable integrations; analyze usage; detect and prevent fraud and abuse; protect security; enforce our Terms of Service; comply with applicable law; and support business operations.
We may use personal information to generate analytics, market insights, rankings, alerts, automations, and other Services-related outputs.
We may use personal information for marketing, promotional communications, events, product announcements, and other communications where you have consented or where permitted by law and subject to your communication preferences.
3. Cookies and Similar Technologies
We and our service providers may use cookies, local storage, IndexedDB, pixels, software development kits, web beacons, and similar technologies to operate and improve the Services, remember preferences, authenticate users, measure performance, analyze traffic, understand usage, prevent fraud, and support marketing.
Cookies we use may include strictly necessary cookies required for the website and Services to function, including session management and login state; analytics cookies used to understand how visitors use the website and Services, such as Google Analytics or equivalent tools; and marketing cookies used to deliver relevant advertising. Analytics cookies and marketing cookies are used only with your consent where required by law.
You may manage cookie preferences through the cookie consent banner displayed when you first visit the website or through your browser settings. Disabling certain cookies may affect the functionality of the website or Services.
4. How We Disclose Personal Information
We do not sell your personal information. We may disclose personal information to service providers and vendors that perform services on our behalf, including hosting, analytics, authentication, customer support, payment processing, communications, security, fraud prevention, data processing, and infrastructure services.
We may disclose personal information to Commas, Inc. for payment processing; Discord, Inc. for community access; analytics providers for website and platform analytics; email service providers for transactional and marketing communications; legal and professional advisers for legal compliance and enforcement; law enforcement, regulators, courts, or government authorities where required by law; and acquirers or other transaction participants in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or due diligence related to such transactions.
We may disclose personal information to business partners, integration partners, third-party platforms, payment processors, wallet providers, messaging services, analytics providers, and other third parties as necessary to provide features you request or interactions you initiate. Where we share personal information with third parties, including service providers in other jurisdictions, we use appropriate contractual and operational safeguards designed to protect personal information.
We may disclose aggregated, de-identified, or anonymized information that does not reasonably identify you, subject to applicable law.
5. Third-Party Services
The Services may link to, integrate with, or enable interactions with third-party websites, wallets, APIs, messaging platforms, analytics tools, payment processors, blockchains, smart contracts, prediction markets, and other services. ArbsXYZ’s source terms describe comparable tools that may allow users to interact with third-party platforms.
This Privacy Policy does not apply to third-party services that we do not own or control. We are not responsible for the privacy practices, security practices, content, terms, or policies of third parties. You should review the privacy policies and terms of any third-party services you use.
If you access or interact with third-party trading platforms, including without limitation Kalshi, Polymarket, or another third-party platform through or in connection with the Services, that third party may independently collect, use, store, disclose, and otherwise process personal information about you under its own privacy policy. Depending on the platform and how you interact with it, that information may include account information, contact information, payment or transaction information, wallet addresses, trading or market activity, communications, log data, usage data, device information, location information inferred from IP address, cookie and tracking information, KYC/AML information, sanctions-screening information, and other information required for onboarding, account administration, market access, clearing, compliance, fraud prevention, analytics, advertising, or customer support.
Third-party platforms may disclose personal information to affiliates, vendors, service providers, payment processors, analytics providers, advertising partners, legal and professional advisers, regulators, law enforcement, courts, exchanges, clearing organizations, futures commission merchants, clearing members, acquirers, and other parties as described in their own privacy policies or as required by law. ArbsXYZ does not control those third-party privacy practices, and your rights with respect to personal information processed by a third-party platform must be exercised directly with that platform unless applicable law provides otherwise.
6. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information. However, no method of transmission, storage, or processing is completely secure. We cannot guarantee that personal information will be secure.
You are responsible for maintaining the security of your account credentials, devices, wallets, private keys, seed phrases, API keys, authentication methods, and connected third-party accounts.
7. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, comply with legal, accounting, or reporting obligations, resolve disputes, enforce agreements, maintain security, prevent fraud, and support legitimate business purposes.
In general, account and subscription data is retained for the duration of your subscription and for up to six years thereafter, subject to applicable U.S. legal and compliance requirements. Financial transaction data is retained for at least six years for tax and accounting purposes. Marketing data is retained until you unsubscribe or withdraw consent. Technical and usage data is typically retained for up to six years. Retention periods may vary depending on the nature of the information, the purposes for which it is processed, applicable legal requirements, and operational needs.
8. Your Choices
You may be able to access, update, or delete certain account information through the Services. You may unsubscribe from promotional emails by following the instructions in those emails, although we may still send you transactional, administrative, legal, or service-related messages.
You may disable cookies through your browser settings, subject to the limitations described above. You may disconnect certain third-party integrations or wallets through the Services or through the applicable third-party platform, where available.
9. Privacy Rights
Depending on your U.S. state of residence, you may have rights under applicable privacy laws, which may include the right to access and request a copy of the personal information we hold about you; the right to request correction of inaccurate or incomplete information; the right to request deletion in certain circumstances; the right to restrict processing in certain circumstances; the right to data portability; the right to object to processing based on legitimate interests or for direct marketing; and the right to withdraw consent at any time where processing is based on consent.
You may exercise these rights by contacting us at support@arbs.xyz. We will respond within one month of receiving your request, subject to applicable law. We may need to verify your identity before processing a request. Authorized agents may submit requests where permitted by applicable law and subject to verification requirements. If you are not satisfied with our response, you may have the right to lodge a complaint with the appropriate regulator in your jurisdiction, such as your state Attorney General.
10. Children’s Privacy
The Services are not intended for children under 18.
We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, or if you believe we have inadvertently collected personal information from a child under 18, please contact us at support@arbs.xyz and we will take reasonable steps to delete it.
11. International Users
If you access the Services from outside the United States, you understand that your personal information may be processed in the United States and other jurisdictions where privacy laws may differ from those in your jurisdiction. By using the Services, you acknowledge that your personal information may be transferred to and processed in the United States and other jurisdictions.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we may provide notice by posting the updated Privacy Policy through the Services, updating the last updated date, sending an email, or using another reasonable method. Your continued use of the Services after the updated Privacy Policy becomes effective means you acknowledge the updated Privacy Policy.
